1. Agreement to Terms
Welcome to Latour’s Air Conditioning & Heating, LLC (“Company,” “we,” “us,” or “our”). By accessing our website at latourshvac.com, scheduling services, or engaging us for any heating, ventilation, and air conditioning (HVAC) work, you (“Customer,” “you,” or “your”) agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
These Terms and Conditions constitute a legally binding agreement between you and Latour’s Air Conditioning & Heating, LLC, a family-owned and operated company based in Lake Charles, Louisiana.
2. Services Provided
Latour’s Air Conditioning & Heating, LLC provides comprehensive HVAC services for residential and commercial properties in the Lake Charles, Sulphur, and surrounding Louisiana areas. Our services include, but are not limited to:
• Air conditioning repair, maintenance, and installation
• Heating and furnace repair, maintenance, and installation
• Heat pump services
• Indoor air quality assessments and solutions
• Air duct cleaning and installation
• Preventive maintenance programs and service contracts
• Emergency repair services
All services are performed by certified, trained technicians experienced with all major makes and models of HVAC equipment.
3. Service Scheduling and Property Access
3.1 Scheduling
Services may be scheduled by calling (337) 912-1233 or through our website. We offer 24-hour availability, including emergency services. Appointment times are estimates, and while we strive to arrive within the scheduled window, delays may occur due to prior service calls or unforeseen circumstances.
3.2 Property Access
By scheduling a service appointment, you authorize our technicians to access your property and HVAC equipment to perform the requested services. You are responsible for ensuring that our technicians have clear and safe access to all relevant equipment, including indoor and outdoor units, thermostats, and electrical panels.
You agree to secure all pets and remove any obstacles that may impede our technicians’ ability to perform services safely and efficiently.
4. Estimates and Pricing
4.1 Estimates
We provide free estimates for new system installations. For repair services, a diagnostic fee may apply, which is typically credited toward the cost of repairs if you choose to proceed with the recommended work. All estimates are valid for 30 days unless otherwise specified.
4.2 Pricing
Prices quoted are based on the information available at the time of the estimate. Additional charges may apply if unforeseen conditions are discovered during the course of work. You will be notified and must approve any additional charges before work proceeds.
We do not charge overtime fees for services rendered outside regular business hours.
5. Payment Terms
Payment is due upon completion of services unless other arrangements have been made in advance. We accept cash, checks, and major credit cards. For larger installations or projects, payment plans may be available upon approval.
Late payments may be subject to interest charges of 1.5% per month or the maximum rate permitted by Louisiana law, whichever is lower. You agree to pay all collection costs and reasonable attorney’s fees incurred in collecting any overdue amounts.
6. Warranties and Guarantees
6.1 Workmanship Warranty
We stand behind our work and offer a workmanship warranty on all repairs and installations. The specific warranty period will be provided to you in writing at the time of service.
6.2 Equipment Warranties
New equipment installations are covered by the manufacturer’s warranty. We will assist you in processing any warranty claims. Manufacturer warranty terms vary by product and will be provided with your equipment documentation.
6.3 Warranty Exclusions
Warranties do not cover damage caused by misuse, neglect, improper maintenance, unauthorized modifications, acts of nature, power surges, or any cause beyond our control. Regular maintenance is recommended to maintain warranty coverage and optimal system performance.
7. Limitation of Liability
To the maximum extent permitted by Louisiana law, Latour’s Air Conditioning & Heating, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services, including but not limited to loss of use, loss of profits, or damage to property.
Our total liability for any claim arising from our services shall not exceed the amount paid by you for the specific service giving rise to the claim. This limitation applies regardless of the legal theory upon which the claim is based.
Nothing in these Terms shall limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
8. Customer Responsibilities
As a customer, you are responsible for:
• Providing accurate information about your HVAC system and any issues you have observed
• Maintaining regular maintenance on your HVAC equipment, including changing filters monthly as recommended
• Ensuring safe and clear access to all HVAC equipment
• Notifying us promptly of any problems following service
• Making timely payments for services rendered
• Keeping outdoor units clean and free of debris
9. Cancellation and Rescheduling
We understand that schedules change. If you need to cancel or reschedule an appointment, please notify us at least 24 hours in advance. Failure to provide adequate notice or repeated no-shows may result in a service call fee.
For service contract customers, cancellation terms are outlined in your service agreement.
10. Service Contracts
We offer preferred customer service agreements that provide priority treatment, discounted maintenance services, and reduced rates on repair work. Service contracts are subject to separate terms and conditions provided at the time of enrollment.
Maintenance services under our service contracts start at $189. Benefits and pricing are subject to change with reasonable notice.
11. Privacy and Data Protection
We collect and use your personal information only as necessary to provide our services and communicate with you. This may include your name, address, phone number, email address, and payment information.
We do not sell or share your personal information with third parties except as necessary to complete transactions, comply with legal requirements, or protect our rights. For more details, please review our Privacy Policy available on our website.
12. Intellectual Property
All content on the latourshvac.com website, including text, graphics, logos, and images, is the property of Latour’s Air Conditioning & Heating, LLC and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any content without our express written permission.
13. Dispute Resolution
In the event of any dispute arising from these Terms or our services, you agree to first attempt to resolve the matter through good-faith negotiation by contacting us directly. If the dispute cannot be resolved through negotiation, both parties agree to pursue mediation before initiating any legal action.
14. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law provisions. Any legal action arising from these Terms shall be brought exclusively in the courts of Calcasieu Parish, Louisiana.
15. Modifications to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon posting to our website. Your continued use of our services after any modifications indicates your acceptance of the updated terms. We encourage you to review these Terms periodically.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms and Conditions, together with any service agreements or contracts you enter into with us, constitute the entire agreement between you and Latour’s Air Conditioning & Heating, LLC regarding the subject matter herein and supersede all prior agreements, representations, and understandings.
